Before loading cargo of D.A.P. at port of Muuga (Tallinn) the check of hatch covers of Holds No. 1 and No. 2 on watertightness and pressure test of stop valves of drainage system of above Holds were carried out by crew. For these tests we used main fire pump with water pressure in the main 6 kgs/sq.cm. No leakage of water through hatch covers and filtration through bilge containers and ballast tanks into the Holds were not found. We also cheked bilge container level alarm and found it in good condition and working properly. 2. Holds inspection was also carried out by surveyors. They found Holds No. 1 and No. 2 clean and dry without any foreign things and to be suitable for loading and transportation of the above said cargo. 3. The air temperature during loading was about minus 5 – minus 3°C and air humidity was high cause sometimes snow falled down and visibility was poor. During the snow hatch covers were closed and loading did not take place. The wind during loading was from northerly direction with speed about 15 m/s. 4. The loading was executed by tipping cargo from 20-foot containers into the Holds. Containers were loaded from rail-wagons by grabs. Due to this and due to negative air temperature cargo might contain wet frozen lump and pieces of ice. 5. Ship sailed from Muuga on the 25th December, 2000 and arrived to Southampton on the 30th December, 2000. During the voyage the air temperature changed from minus 3 to plus 5°C. 6. Due to it nature the cargo of DIAMMONIUM PHOSPATE is very hygroscopic and may take moisture from air. In reason of above I suppose that alleged damage of cargo arised as the result of temperature difference and moisture condensation on the metallic surfaces like bottom, boards and hatch covers of the Hold No. 1. In the circumstances I have to make an official statement that neither my m/v “STK 1012” nor my shipowners will bear no responsibility for any claims which may arise in connection with damage of cargo of D.A.P. Ship must have always good chance to close hatches to prevent ingress of moisture into the holds in the issue of precipitation. Also, please, draw your attention to properly trimming cargo in the holds. According to preliminary cargo plan it is necessary to fill Hold No.2 to level of limit lines drawn at coaming and load in the Hold No.2 minimum 920.0 mt of cargo. The rest part of cargo should be loaded in Hold No.1 otherwise ship could not take full cargo. Ship must have always good chance to close hatches to prevent ingress of moisture into the holds in the issue of precipitation. Also, please, draw your attention to properly trimming cargo in the holds. Sawntimbers were kept on unprotected storage protractedly. 2. Some boards in packages changed colour as a result of long-term exposure of moisture. 3. All packages are stained 4. Bands are weak. In reason of this I shall bear no responsible for the all claims and other consequences, which may arise therefrom and I have to make following remarks in all bills of lading: 1. LOADED FROM OPEN STORAGE. 2. ALL PACKAGES COVERED WITH WET SPOTS AND STAINED, BOARDS DISCOLOURED AND DARKEN. 3. BANDS ARE WEAK. Today, on the 8th December 2000 at 05.00 LT during loading cargo of M.A.P. via pipe transporter to Hold No.2 of m/v “STK 1012” level of cargo has been exceeded the height of hold coaming and obstruct to close the holds by hatch covers. This happened due to failure by Chief Stevedore A. GANENKO to execute requirement of ship’s administration concerning trimming of cargo which was handed to Stevedores in written form. At 05.10 LT drizzle was started and trimming of cargo was fulfilled during precipitations and some moisture ingressed into the Hold No.2. In view of above I hold Stevedoring Company for damage to the cargo and all claims and other consequences, which may arise therefrom and I would kindly request you advise the said Stevedoring Company, Consignees and all concerned.
