Financial Regulation (1605/2002) and
Implementing Rules (2342/2002)
Set the scope of grants, the procedure for awarding them and
the arrangements for payment and controls.
• Grants are direct financial contributions, by way of donation,
from the budget in order to finance:
• either an action intended to help achieve an objective
forming part of an EU policy;
• or the functioning of a body which pursues an aim of general
European interest or has an objective forming part of an EU
policy.
• Grants must involve co-financing and may not have the
purpose or effect of producing a profit for the beneficiary.

Финансовый регламент и правила
осуществления
Устанавливают правила для всех грантов ЕС, процедуру их
присуждения и необходимые средства организации платежей и
контроля
•Гранты вляются прямым финансовым вкладом, осуществляющийся
путем денежного пожертвования из бюджета ЕС для финансирования:
• Либо
деятельности
которая
подразумевает
способствование достижению целей составлющих часть
политики ЕС ;
• Либо функционирования организациии, которая преследует
цель совпадающую с общими европейскими интересами или
имеет цель которая явлается частью политики ЕС.
•Гранты должны включать со-финансирование и не могут иметь
целью получение прибыли Бенефициарием (имеется в виду
получение дохода по сравнению с расходами).

ENPI Regulation (1638/2006) and ENPI CBC
implementing rules (951/2007)
• ENPI regulation: establishes general provisions for European
Neighbourhood and Partnership Instrument (including rule of
origin & nationality for tenders - art.21)
• ENPI CBC implementing rules: establishes the rules for the
implementation of ENPI cross-border programs (ENPI CBC),
and in particular:
Contractual procedures (art. 23): ‘The contractual procedures for
procurement contracts and grants necessary for implementation of the
joint operational programme by the Joint Managing Authority shall be
those applicable to external actions (…). The procedures and related
standard documents and contract templates to be used shall be those
included in the Practical Guide to contract procedures for EC
external actions with annexes in force at the time of the launching of
procurement procedures or calls for proposals.’

Регламент ЕИСП и Правила осуществления
ЕИСП ПГС
• Регламент ЕИСП (1638/2006): устанавливает общие положения
которые регулируют создание ЕИСП (Европейского инструмента
соседства и партнерства), в том числе правила происхождения и
гражданства для тендеров.
• Правила осущестления ЕИСП ПГС (951/2007): устанавливает
правила осуществления приграничных программ, которые
финансируются ЕИСП, а именно:
Процедуры подписания контрактов (ст. 23): Процедуры и
связанные с ними стандартные документы и образцы
контрактов прописаны и должны использоваться как они
указаны в Практическом руководстве к контрактным
процедурам для внешних действий ЕК с приложениями
действующем во время осуществления конкурса заявок.

Financing Agreement with Russia
• Key legal basis for project implementation in Russia is the
“Financing Agreement between the Government of the
Russian Federation and the European Community on
Financing and Implementing the Cross Border Cooperation
Programme ‘Estonia-Latvia-Russia’” (FA)
– Signed on 19 November 2009 in Stockholm by Minister of
Regional Development of the Russian Federation V.F. Vasargin
(both English and Russian versions have equal legal effect)
– Ratified by Russian Federation Duma on 16 July 2010:
Federal Law of 27.07.10 N°232 FZ « On ratification of the
Agreement between the Government of the Russian Federation
and the European Community on financing and implementing the
Estonia-Latvia-Russia ENPI CBC programme »

The partnership agreement
A framework specifying key roles and obligations for:
• The Beneficiary
• Overall legal and financial responsibility for project implementation
• Receives the financial contribution from the JMA and ensures it is
managed and distributed to partners in accordance with the
partnership agreements
• Directly accountable to the JTS/JMA for the operational and
financial progress of activities and providing reports
• Responsible for coordination and keeping partners informed of
project overall progress and contractual changes

• Appropriate use of funds (sound financial management, respect of
accounting, procurement and visibility rules)

– Reporting templates and requirements (language, which
attachment…), procedures to jointly agree on reports
– Internal communication procedures
– Procedures for the ‘open-to-control’ period
