What is a Protection from Abuse Order?

 A Protection From Abuse Order is a paper signed by a judge that tells the
abuser to stop the abuse or face serious legal results including jail and fines.
(Ордер PFA (ордер на защиту от насилия) – это документ, подписанный судьей, в

 The victim is called the Plaintiff.

 The abuser is called the Defendant.

 The meeting before a Judge is called a Hearing.

Who Can Request a Protection from Abuse Order (PFA) in Pennsylvania?

 If you are an Adult (person 18 years old or older), or an Emancipated
Minor, you can seek legal protection from acts or threats of domestic abuse

or violence done to you or to your minor child by a family or household
member, which includes:

How can a Protection from Abuse Order protect the Plaintiff?

 Tell the Defendant not to abuse, harass, or stalk you, your relatives, or
minor children (person under age 18).
(Предписывать Ответчику не совершать насилие, не домогаться, не
преследовать Вас, Ваших родственников или несовершеннолетних детей (лиц до
18-летнего возраста)).
 Order the Defendant to be removed from the home where you both live, or,
if you live separately, Exclude the Defendant from visiting your home.


Award temporary custody of your minor children to you.

 Prohibit the Defendant from having any contact with you or your minor
children.

 Order the Defendant to pay financial support to you.

 Order the Defendant to turn in any guns or weapons to the Sheriff/ Police.

How much does it cost to file for a Protection from Abuse Order?

 You do not have to pay any fees when you petition the court for a
Protection from Abuse Order.

 If you are granted a Protection from Abuse Order the judge may require
the Defendant to pay all the fees of filing and service as well as an
additional $100.

Do I need a Lawyer to Petition for a Protection from Abuse?

 No, you do not need a lawyer to file a petition for a Protection from Abuse
Order.

 It is generally better to have a lawyer, especially if the Defendant has a
lawyer. If you cannot afford a lawyer, the Centre County Women’s
Resource Center may be able to help find affordable legal services.

What steps must a victim take to get a Protection from Abuse Order?

 The Plaintiff fills out a form called a Petition.

 The Petition includes information about specific types of abuse.

 The Plaintiff petitions the court for a Temporary Protection from Abuse
Order.

 Based on the information in the Petition, a Judge makes a decision:

 To schedule a Hearing to get more information, and possibly

 To deny the Petition for a Temporary Protection from Abuse
Order. The Plaintiff can then request a Hearing for a Protection
from Abuse Order.

 If a hearing is scheduled, both the Plaintiff and the Defendant will tell the
judge what happened about the abuse or events reported in the Petition.

 Both the Plaintiff and the Defendant can bring Witnesses to the
Hearing.

 Witnesses can include family/household members or others (friends,
neighbors) that can provide information to the judge about the abuse
or threats of abuse by the Defendant, as reported by the Plaintiff.
